Legal Aid funding

Please note that this information only applies if you are located in Tasmania. We do not undertake matters funded by legal aid in other States or Territories.

Austin-Stone Lawyers is registered with Tasmania Legal Aid and assists with suitable matters on the basis of legal aid funding. Tasmania Legal Aid does not fund all matters, and applies a strict means test and merit test in most circumstances. Tasmania Legal Aid publishes detailed funding guidelines here. Please note that Austin-Stone Lawyers does not determine the funding guidelines and cannot grant you legal aid - we will, however, process a legal aid application on your behalf if your matter is suitable.

We only undertake the following matters on the basis of legal aid funding:

  • Criminal matters in the Magistrates Court of Tasmania; and/or

  • Family violence matters in the Magistrates Court of Tasmania, including applying for a Family Violence Order, defending a Family Violence Order application, or applying to vary or revoke a Police Family Violence Order or Family Violence Order.

 

If you wish to apply for legal aid funding:


1. Complete a Legal Aid Application by clicking on the 'Application Form' button below.
2. If you are currently employed, please email a copy of a recent payslip and three months of bank statements to office@austinstone.com.au

Please check your emails regularly so that you do not miss any correspondence from our office.

If Legal Aid funding is granted, you will generally be sent an invoice for the amount of $60.00 or more, as Tasmania Legal Aid requires most recipients of funding to pay this amount towards their legal costs. This amount may vary depending on your financial situation, and will be formally assessed by Tasmania Legal Aid if funding is granted. Please ensure that you are in a position to pay this amount as soon as Legal Aid is granted, as Austin-Stone Lawyers is unable to act for you if you are not able to pay a contribution. This amount is non-refundable.

In some circumstances, Tasmania Legal Aid may waive the contribution amount of $60.00 or more if you are in financial hardship. If you believe you are in financial hardship, please contact us via email to discuss.

Contribution amounts do not currently apply to matters which are referred or accepted under the Tasmania Legal Aid Safe at Home scheme.
